By accessing or using the Carkila platform, you agree to be bound by the following Terms and Conditions. Please read them carefully before using the platform.
1. Definitions
- Carkila – The online platform owned and operated by carkila.com that connects vehicle rental operators with individuals and businesses across the Philippines.
- User – Any individual or organization accessing or using the platform, including both renters and operators.
- Renter – A person or company booking or inquiring about vehicle rental.
- Operator – A person or company listing and offering vehicles for rent.
2. Eligibility and Platform Use
- Users must be at least 18 years old.
- All information provided must be complete, accurate, and truthful.
- Carkila reserves the right to suspend or terminate any account for violations of these terms or for engaging in any illegal or prohibited activities. Any such activity may be reported to the relevant authorities.
3. Account Registration
- An account is required to access the full features of the platform.
- Users are responsible for maintaining the confidentiality of their account credentials and activities under their account.
- Any unauthorized access must be reported to Carkila immediately.
4. Listings and Bookings
- Operators are responsible for the accuracy of their listings, vehicle condition, and legal compliance (e.g., registration, insurance, permits).
- Renters must carefully review all listing information and verify legitimacy before proceeding with any bookings or payments.
- All bookings are subject to Operators confirmation. Quotations will be provided directly by Operators.
- Carkila strongly advises Renters to verify the credibility of Operators before sending any payment. Payments made outside the platform are at the user’s own risk.
5. Payment and Fees
- Carkila may process listing fees or listing credit purchases using trusted third-party payment providers.
- Carkila and its staff do not collect commissions from Operators for bookings made on the platform.
- Carkila is not liable for payments, disputes, or refunds related to rentals made outside the platform.
6. Cancellations and Refunds
- Renters must clarify with Operators all terms related to cancellation, refund and payment before finalizing a booking.
- Each Operator may have a different refund policy. Renters should review these terms carefully.
- Carkila may offer assistance in resolving disputes but not liable for rental fee refunds.
7. Listing Credits and Payments
- Listing credits are valid immediately upon purchase and are non-refundable and non transferable.
- Listing credits cannot be converted into cash or any monetary equivalent.
- All transactions are handled via third-party payment gateways.
- If technical issues occur during credit purchases, please contact Carkila support for resolution.
8. User Responsibilities
Renters must:
- Use rented vehicles responsibly and return them in the condition agreed upon.
- Understand that sharing personal information (e.g., ID, license) is done at their own risk. Carkila is not liable for data loss, theft, or misuse.
- Adhere to all Operator policies, traffic laws, and government regulations.
- Inspect vehicles before use. Carkila is not responsible for mechanical failure or breakdowns.
- Carkila does not guarantee vehicle availability, punctuality, or performance.
Operators must:
- Ensure all vehicles are clean, roadworthy, registered, and covered by appropriate insurance.
- Communicate all rental conditions clearly, including eligibility, terms, and pickup arrangements.
- Refrain from using photos of vehicles they do not own or have permission to list.
- Avoid scams or fraudulent behavior. Such behavior will result in immediate account termination and legal action.
- Comply with all transportation laws, industry standards, and government permits.
9. Vehicle Damage and Responsibility
- Renters are fully responsible for any damage, loss, fines, or penalties incurred during the rental period.
- Operators are expected to document the vehicle’s condition before and after the rental.
- Carkila is not liable for disputes, damage, or repair costs but may assist in communication and documentation.
10. Insurance
- Operators are strongly encourage to maintain comprehensive vehicle and third-party liability insurance. Including passenger insurance.
- Renters are responsible for confirming if the vehicle includes insurance coverage for drivers and passengers.
- Carkila does not provide insurance coverage and is not responsible for uninsured vehicles or incidents.
11. Vehicle Legitimacy and Compliance
- Only legally registered vehicles with appropriate permits may be listed.
- Operators agree to maintain updated and valid documentation at all times.
- Carkila is not liable for loss or disputes involving unregistered, stolen, or illegally listed vehicles.
12. Privacy and Data Handling
- Carkila collects and manages data in accordance with its Privacy Policy.
- Personal and contact details may be shared between Renters and Operators only as needed to complete bookings.
- Carkila does not sell user data to third parties.
13. Limitation of Liabilities
- Carkila is a facilitator and not a party to rental transactions.

Carkila is not responsible for:
- Vehicle condition, safety, or legality
- Late arrivals, no-shows, or cancellations
- Accidents, damages, or mechanical failures
- Misconduct or disputes between Users
- All platform use is at your own risk.
14. Modifications to Terms
- Carkila reserves the right to modify these Terms and Conditions at any time.
- Users will be notified of changes via the platform. Continued use indicates acceptance of the updated terms.
15. Governing Law
- These terms are governed by the laws of the Republic of the Philippines.
- Any disputes arising under the terms shall be settled in the appropriate courts within the Philippines.
16. Dispute Resolution
- In the event of a dispute between Users, Carkila may offer mediation or communication support.
- However, Carkila does not act as an arbitrator and is not obligated to resolve disputes between parties.
- Users agree to attempt to resolve conflicts directly with one another before taking legal action.
17. Prohibited Conduct
Users are strictly prohibited from:
- Posting false, misleading, or fraudulent listings.
- Using the platform to conduct or promote illegal activities.
- Impersonating other individuals or businesses.
- Uploading harmful code, spam, or unauthorized advertising.
- Harassing, Threatening, or abusing other users.
- Listings unrelated to the transportation and logistics industry such as those involving food, real state, or other non-relevant categories are strictly prohibited on the platform.
Violation of these rules may result in account suspension or permanent ban without prior notice.
18. Intellectual Property
- All content on the platform including logos, texts, design, and system functionalities belongs to Carkila or its licensors.
- Users may not copy, reproduce, or exploit any part of the platform without express written permission from Carkila.
19. Force Majeure
Carkila is not liable for any failure or delay in service caused by events beyond our reasonable control, including but not limited to:
- Natural disasters.
- Internet outages.
- Acts of government.
- Civil unrest.
- Strikes or labor disputes.
- Pandemic-related restrictions.
20. Termination of Access
- Carkila reserves the right to suspend or permanently terminate access to the platform for any violation of these Terms.
- Users may also deactivate their accounts by contacting support.
- Upon termination, all rights to use the platform will immediately cease.
